The Holiday Cheers (“Sweepstakes”) is open only to individuals who are legal residents of Ontario and who are nineteen (19) years of age or older at the time of entry (unless otherwise excluded by Sponsor in accordance with applicable law), playing physically within the province of Ontario (for those entering via the Wager method (as described in Section 4 below)), and have an active, KYC verified BETMGM account (“BetMGM Account”). The Sponsor reserves the right to verify the eligibility of all Participants. Additionally, any individual with a BetMGM account on any product in one (1) or more jurisdictions where the Sponsor operates, that has been involuntarily closed, suspended (including any accounts in cool-off status), or where such account has been marked as fraudulent, is ineligible to participate in, and/or receive a prize, for this Sweepstakes even where such entrant may seek entry in this Sweepstakes through an active account in another jurisdiction.

ACTION REQUIRED:

6. How to Participate: No Purchase Necessary to Enter or Win. For each eligible entry that you submit during an Entry Period (up to one (1) entry per Entry Period). No further steps must be taken. You may enter the Sweepstakes in any of the following ways:
   1. Method: For each Entry Period, once you have logged into your BETMGM account in Ontario and opted into the Sweepstakes, you may earn one (1) entry by wagering at least $20 (minimum -200 odds) to receive an entry. Your wager must be received by Sponsor within the applicable Entry Period in order for it to be an eligible entry for that Entry Period.
   2. Alternative Method of Entry (“AMOE”) – Mail-In Entry: Participants may earn one (1) entry by providing the Participant’s complete name, street address, city, province, ZIP code, daytime and evening telephone numbers (including area code), BetMGM Account user ID, and valid email address, on a plain piece of 3.5" x 5" paper, and mailing it to BetMGM Marketing, attn The Holiday Cheers, 88 Queens Quay W, Floor 25, Toronto, ON M5J 0B6 each week. Mail-in entries must be postmarked on a date that is between (and including the start date and end date of the Promotional Period) and received no more than five (5) days after the end date of the Promotional Period to be eligible. The postmark date on mail entries will be considered the date of entry.

Any attempt by any Participant to obtain more than the stated number of entries, including by using multiple/different Sportsbook Accounts, identities, registrations and logins, or any other methods, will void that Participant’s entries and that Participant may be disqualified from the Sweepstakes. Use of any automated system to participate is prohibited and will result in disqualification. Entries submitted by Participants who do not meet the eligibility requirements set forth in section 1 above (including all requirements with respect to age and residence) are void. Each Participant must be the rightful owner of the email address and/or BetMGM Account used (the authorized account holder) to enter the Sweepstakes. The authorized account holder is deemed the natural person who is assigned to an email address by the online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the email address and/or Sportsbook Account associated with the winning entry and that all eligibility requirements are met.

For purposes of this Sweepstakes, an online entry is received when Sponsor’s Website’s servers record the entry information, and a mail-in entry (if applicable), when such entry is physically received by Sponsor at the address provided herein. Proof of sending (such as an automated computer receipt confirming entry or “thanks for entering” message) does not constitute proof of actual receipt of an entry for purposes of this Sweepstakes. The Website’s database clock will be the official timekeeper for this Sweepstakes. Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel or suspend this Sweepstakes (or any portion of the Sweepstakes) for any reason, including, without limitation, should an error, virus, bug, computer problem or other cause or issue corrupt, restrict, prevent or inhibit the administration, security or proper operation of the Sweepstakes and, in such situation, to select the winner from the remaining eligible non-suspect entries received prior to and/or after such action or in such manner as deemed fair and appropriate by Sponsor in its sole and absolute discretion. Sponsor may prohibit a Participant from participating in the Sweepstakes or winning the prize if, in its sole and absolute discretion, Sponsor determines a Participant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other Participant or Sponsor’s representatives. No more than the stated number of prizes will be awarded. 34. Each entrant must be the rightful owner or have authorized use of the email account associated with the entrant’s submitted email address (if provided). If a dispute arises about who submitted an entry, the entry will be deemed submitted by the authorized account holder of the BetMGM account provided. The “authorized account holder” is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Each potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.;

No waiver of any of the provisions of these Terms & Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Terms & Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms & Conditions, which will otherwise remain in full force and effect.

You understand that all information is being provided to Sponsor and not to Facebook, Instagram, X (formerly known as Twitter), YouTube, Google or any other social media where this Sweepstakes may be promoted, advertised or otherwise used to disseminate information relating to the Sweepstakes. Sponsor is not responsible for practices, terms or actions taken by any of these or other social media and web services sites. 41. This Sweepstakes is intended for viewing in Ontario only and shall be construed and evaluated only according to Canadian law. Do not enter this Sweepstakes if you are not located in Ontario and, more specifically, comply with eligibility requirements set forth herein. The use of any automated devices in connection with this Sweepstakes is prohibited. Sponsor assumes no responsibility for computer system, hardware, software, or program malfunctions or other errors, failures, delayed computer transactions, or network connections, whether human, technical, or otherwise in nature. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should virus, bugs, or other causes beyond its control corrupt the administration, security, or proper play of this Sweepstakes. 42. The invalidity, illegality, or unenforceability of any provision of these Terms & Conditions shall in no way affect the validity, legality, or enforceability of any other provision hereof. Any invalid, illegal, or unenforceable provision shall be deemed severed from these Terms & Conditions and the balance of these Terms & Conditions shall be construed and enforced as if these Terms & Conditions did not contain such invalid, illegal, or unenforceable provision.

WINNER’S SELECTION AND NOTIFICATION:

44. The drawing for each entry Period will take place at least five (5) days after the conclusion of the entry Period. ONE (1) potential winner(s) will be selected in Choose an item. random drawing by representatives of Sponsor from among all eligible entries received during Choose an item. Period. For each Entry Period, the odds of winning the Prize associated with such entry Period depends on the total number of eligible entries received for such Entry Period. The drawing for the Grand Prize Package will take place at least five (5) days after the conclusion of the Promotional Period, where number (#) potential Grand Prize winner will be selected in a random drawing by representatives of Sponsor from among all eligible entries received during the Promotional Period. The odds of winning the Grand Prize depend upon the total number of eligible entries received for the Grand Prize drawing. Selected potential winner(s) will be notified via email and/or telephone.
45. Sponsor is not obligated to leave a voice recording or other message if the potential prize winner does not answer Sponsor’s telephone call. The selected potential winner will be required to respond to the notification with the required information within five (5) business days of the date and time notification was sent/attempted by the Sponsor, or the Prize will be forfeited. To receive the Prize, the selected potential winner must continue to comply with these Terms & Conditions and fulfill all requirements set forth herein.
46. Potential winner may be required to sign and return an Affidavit of Eligibility, Liability, & Publicity Release (“Affidavit”) and a Canadian W8BEN, Canadian T4A, IRS Form W-9, and/or IRS Form 1099 (if applicable) to Sponsor. If required by Sponsor, these documents will be sent out to the potential winners by email along with instructions on how to return them to Sponsor. In addition, each potential winner’s guest, if any, may (in sponsor’s sole discretion) be required to execute and return a release of liability as directed in order to participate in the prize as the winner’s guest. The selected potential winners may be required to provide their Canadian Social Insurance Number for tax purposes. Sponsor reserves the right to modify the notification and Affidavit procedures in connection with the selection of any alternate winner. Sponsor may share each potential winner’s name and contact information with Sweepstakes Entities and/or any prize provider, as applicable, if necessary. Upon completion and acceptance of the Affidavit, and once a potential winner provides the necessary proof of travel documents, if any, then he or she will be declared the winner.

48. A selected potential winner may be disqualified (and may forfeit the prize) if such selected potential winner (i) is unreachable or does not timely respond to any communication from Sponsor (or its designee) (or if a winner notification is returned as undeliverable), (ii) declines or cannot accept, receive or use the Prize for any reason, (iii) fails to sign and return Affidavit within the required time period, and/or (iv) does not comply with these Terms & Conditions. In the event that a selected potential winner is disqualified and/or is unable to satisfy the requirements herein, Sponsor will use reasonable efforts to award the Prize to an alternate winner selected from among the remaining eligible entries (if necessary and time permitting) who successfully meets the requirements to receive the Prize, but Sponsor reserves the right to not award the Prize if Sponsor is unable to identify an eligible alternate winner (if any) to accept the Prize.

Any federal, state, and/or local taxes (including income and withholding taxes) and all other costs and expenses associated with acceptance and use of the Prize not specified herein as being awarded are winner’s sole responsibility, including without limitation, ground transportation, luggage fees, meals, gratuities and souvenirs associated with the Prizes.

Notwithstanding anything to the contrary herein, stated on-air, published online, or otherwise communicated to a potential winner, no potential winner of will be entitled to receive the Prize until Sponsor has verified such potential winner’s eligibility and compliance with these Terms & Conditions and until such potential winner has completed and submitted all documents required by Sponsor.
