PROMOTIONAL PERIOD:

1. This Promotion (“Sports Promotion”) is available to qualifying customers from February 17^th – February 19^th 2023, or until Prizes (as defined below) are no longer available, whichever occurs first, unless terminated earlier in BetMGM’s sole discretion.

WHO QUALIFIES FOR THIS SPORTS PROMOTION:

This Sports Promotion is open to participants who are located and playing physically within the province of Ontario at the time of wagering, at least 19 years of age or older, not on an exclusion or self-exclusion list, and have an active, KYC verified BetMGM Sports Ontario Account. All personal and contact data associated with the player’s account must be verifiable.
3. Employees, officers, directors, members and representatives of BetMGM, LLC (the “Promoter”), National Football League, their parent and affiliate companies, and any advertising agency or web company connected with the Promoter (collectively, “Promotion Entities”), as well as immediate family members (spouse, parents, siblings and children) and household members of each such employee, are not eligible to participate in this Sports Promotion. The Promoter reserves the right to verify the eligibility of all participants. Promoter additionally reserves the right to refuse or otherwise restrict your eligibility to participate in the Sports Promotion for any reason, in its sole discretion, including based on your wagering patterns or wagering history.

HOW TO CLAIM THIS SPORTS PROMOTION:

4. To claim this Sports Promotion, visit www.betmgm.com or the BetMGM Sports mobile application and log into your BetMGM Sports account. Then, access the promotions page or tab, opt-in to this Sports Promotion, and place pre-game or live wagers on any NBA All Star Games during All Star Weekend totaling at least $100 (“Qualifying Bet”) between (February 17^th 2023, at 2:00pm ET to February 19^th, 2023 at 11:59pm ET).
5. Bets utilizing “Sports Reward” funds will not be considered Qualifying Bets for this Sports Promotion. A bet will not be considered a Qualifying Bet for the purposes of this Sports Promotion if for any reason it becomes void. A bet placed using either an “Odds Boost Token” or “Bet Insurance Token” will not be considered a Qualifying Bet for the purposes of this Sports Promotion.
6. On placing your Qualifying Bet(s), you’ll become eligible to receive two (2) tickets to “The Ticket & The Truth” live podcast recording on February 23^rd 2023 (“Prize”), regardless of your wager’s outcome. Promoter will award up to 100 total Prizes (ERV $300 per Prize). Prizes will be awarded on a first-come, first-served basis to the first 100 eligible participants. PRIZES WILL BE AWARDED WHILE SUPPLIES LAST.
7. Sports Rewards will not be considered Qualifying Bets for this Sports Promotion. A bet will not be considered a Qualifying Bet for the purposes of this Sports Promotion if for any reason it becomes Void. A bet placed using either an Odds Boost Token or Bet Insurance Token will not be considered a Qualifying Bet for the purposes of this Sports Promotion.
8. After placing your Qualifying Bets, you will receive a notification via phone on how to claim your Prize. Promoter may share each potential winner’s name and contact information with any third parties involved in providing the prize, as applicable, if necessary. Each potential winner will be required to respond to the notification with the requested information within one (1) business days of the date and time notification was sent/attempted by Promoter, or the Prize will be forfeited. Potential winners may be required to sign and return an Affidavit of Eligibility and Liability & Publicity Release (“Affidavit”) and any tax forms to Promoter. If required by Promoter, these documents will be sent out to the potential winners by email along with instructions on to how to return them to Promoter. In addition, each potential winner’s guest, if any, may (in Promoter’s sole discretion) be required to execute and return a release of liability as directed in order to participate in the Prize as winner’s guest. Promoter reserves the right to modify the notification and Affidavit procedures in connection with the selection of any alternate winner. Promoter may share each potential winner’s name and contact information with Promotion Entities and/or any prize provider, as applicable, if necessary. Upon completion and acceptance of the Affidavit and once a potential winner provides the necessary proof of travel documents, then he or she will be declared a winner.

9. All details of Prizes will be determined by Promoter in its sole discretion. Promoter reserves the right to substitute a Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prizes are the sole responsibility of winners. Prizes cannot be transferred by winners or redeemed for cash and are valid only for the items detailed above, with no substitution of Prizes by winners. If a Prize is unclaimed within a reasonable time after notification from Promoter, as determined by Promoter in its sole discretion, Prize will be forfeited.

10. Prize winner must be able to attend the applicable event, or Prize will be forfeited. Promoter shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Promoter’s control, and is not responsible or liable for any expenses incurred as a consequence thereof. Prize will be awarded “as is” with no warranty or guarantee, either express or implied by Promoter. Date and/or time of event is subject to change. Event is subject to cancellation. Promoter will not replace any lost or stolen tickets. Winner and guest, if any, must comply with all applicable venue rules and regulations in connection with Prize. If winner chooses to attend the event with fewer than the permitted number of guests, the remaining elements of Prize shall constitute full satisfaction of Promoter’s Prize obligation to winner and no additional compensation will be awarded. Guests, if any, may be required to execute and return releases of liability and, where legal, publicity releases, or guest portion of the Prize will be forfeited. If any guest is a minor, the winner must be such minor’s parent or legal guardian. Prize is subject to certain terms and conditions as specified by issuer. Restrictions may apply. PRIZE DOES NOT INCLUDE ACCOMMODATIONS, PARKING, OR TRANSPORTATION BEYOND THAT DESCRIBED ABOVE.

11. Each selected potential winner may, in Promoter’s sole discretion, be required to show a valid state issued driver’s license, government-issued identification or other identification (subject to Promoter’s approval) as evidence of identity.
12. Entry to venues, outlets, or other events may be subject to entry requirements such as (i) the use of face coverings while in public spaces (ii) proof of being fully vaccinated for COVID-19 as per CDC Guidelines and/or (iii) proof of a recent negative COVID-19 test.

If such entry requirements are required and an individual is unable to comply with such entry requirements, then such individual will not be allowed into the venue or event. Winners and guests are responsible for all costs and expenses associated with applicable entry requirements including, but not limited to, cost for COVID-19 tests. Each winner and guest seeking entry to the show represents and warrants that he/she is not required to quarantine or isolate as per CDC Guidelines and shall not seek entry to the show if he/she is required to quarantine or isolate as of the show date. Guests understand, and agree, that such medical and health related information will be provided to and/or shared with affiliates, and subsidiaries as well as with third parties on a need-to-know basis.

As noted by government health officials, complete isolation from the COVID-19 virus or any other communicable disease is impossible. Accordingly, we cannot and do not promise to eliminate the risk of exposure to COVID-19 or any other communicable disease and cannot and do not promise that you will not contract COVID-19 or any other communicable disease. You acknowledge that we have informed you that our facilities are not risk-free, that it is possible that you may contract COVID-19 or any other communicable disease during your presence at our facilities, and that you freely choose to enter our facilities with awareness of the associated risks.

Except where prohibited by law, by accepting a Prize, each winner and guest agrees and acknowledges that Promoter and its designees may, without any limitation or further compensation, use his or her name, image, voice, biographical data and/or likeness in any and all media now known or hereinafter devised, throughout the universe and in perpetuity, for any commercial purpose including, but not limited to, advertising and promoting the Promotion or any other promotion, contest or Promotion sponsored by the Promoter.
14. Limit one Prize per person or household (IP address).

15. This Sports Promotion cannot be used in conjunction with any other BetMGM Sports Promotion.
16. Promoter will have complete discretion over interpretation of these Terms and Conditions, of administration and operation of the Sports Promotion, and of selection of the winner(s). Decisions of the Promoter will be final and binding in all matters related to the Sports Promotions. Promoter reserves the right to change or end any Sports Promotion for any reason, including, without limitation, if required for legal and/or regulatory reasons.

By entering and/or claiming this Sports Promotion, each participant agrees for participant and for participant’s heirs, executors, and administrators (a) to release and hold harmless Promotion Entities, and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such participant’s participation in this Sports Promotion and/or his/her acceptance, possession, use, or misuse of the Prize(s) or any portion thereof (including any travel related thereto); (b) to defend and indemnify Released Parties from any and all claims or liability resulting or arising from this Sports Promotion and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize(s), including express warranties provided exclusively by prize provider that are sent along with the Prize(s); (c) if selected as a winner, to the posting of such participant’s name on Promoter’s website and/or mobile application and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Terms and Conditions and to waive any right to claim any ambiguity or error therein or in this Sports Promotion itself, and to be bound by all decisions of the Promoter, which are binding and final. Failure to comply with these conditions may result in disqualification from this Sports Promotion or forfeiture of the Prize(s) at Promoter’s sole discretion.

Released Parties shall not be liable to any winner or any other person for failure to supply the Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, epidemic, public health emergency, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Promoter’s sole control (“Force Majeure Event”). A Force Majeure Event expressly includes (i) an outbreak or resurgence of COVID-19 (as defined by the World Health Organization, which, together with any related strains, variants and mutations thereof and other similar infectious diseases, are collectively referred to herein as “COVID-19”) or, (2) action, order, regulation or guidance taken or issued by a government authority in response to an actual or threatened outbreak or resurgence of COVID-19.

Released Parties are not responsible for and shall not be liable for: (i) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in this Sports Promotion; (ii) technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled, or delayed computer transmissions which may limit or interfere with a participant’s ability to take part in this Sports Promotion; (iii) unauthorized human intervention in any part of the entry process of this Sports Promotion; (iv) technical or human error which may occur in the administration of this Sports Promotion or the processing of entries; (v) late, lost, delayed, misdirected, incomplete, unreadable, inaccurate, undeliverable, damaged or stolen entries or notices (including winner notifications, if applicable); (vi) data corruption, theft, destruction, unauthorized access to or alternation of entry or other materials; (vii) any printing, typographical, human, administrative or technical errors or omissions in any material associated with this Sports Promotion; and/or (viii) any injury, loss, costs, expenses or damages to persons or property (including, but not limited to, damage to any computer system or mobile device related to participation in, accessing or downloading information related to this Sports Promotion) which may be caused, directly or indirectly, in whole or in part, from participant’s participation in this Sports Promotion or any related activity; and/or (ix) any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any persons.

18. The Sports Promotion is subject to all applicable federal, state, provincial and local laws and regulations and is void where prohibited or restricted by law.
19. Promotor reserves the right to alter, discontinue or terminate this promotion, or any aspect of it, at any time, with or without notice, for any reason whatsoever, including without limitation if there has been any printing, production, distribution or other error in any promotion communication or on the platform, or where there has been any error in the preparation for or conduct of any promotion affecting the result of the promotion or the number of participants or the value of the claims.
20. Promotor reserves the right to change or cancel this promotion in its entirety, or exclude any individual or individuals from participation, if it determines at its sole discretion that there are any irregularities or abuses occurring in connection with the promotion.
21. The games and products to which this promotion applies only available to players physically present in the Province of Ontario.
